1. Terms

By accessing this "Maternidad Leve" school (the "School") brought to you by Erika Urbaez and Prolactancia (collectively "Prolactancia"), you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

Please note:

a) We are extremely passionate about delivering comprehensive and supportive tips, advice and encouragement to help your family sleep better, eat better, and with deep consciousness about breastfeeding principles, compassionate development, love and care for you, and your child.

b) We have undertaken extensive research and training to be in the position to provide you with expert sleep and breastfeeding support. While this is most certainly fact, our advice and opinions are freely available to the public across the globe. As such, you may encounter comments and opinions expressed on our site that are not our own and may misconstrue our intent; those providing comments are providing theirs alone, and do not reflect the opinions of any authors or third-party we mention.

c) All contents included in the courses “Tu Bebe Si Duerme®”, “Destetar, Si o No®”, and “Extracción Efectiva®” such as e-guides, e-Books, advice, evaluative consultations, text, graphics, images, and other material contained on these courses provided by Prolactancia (the “Content”) are for informational and supportive purposes only. The Content is not intended to be a substitute for professional or medical advice, diagnosis, or treatment.

d) Always, always, always seek the advice of your physician or another qualified healthcare provider with any questions you may have regarding your or your child’s medical condition(s), behaviors, feeding and sleeping habits, and environment. Never disregard professional medical advice or delay in seeking it because of something you have read on the Prolactancia site!

e) You understand that by using the School and accessing the Content, you may encounter materials that you may find to be explicit, offensive, or otherwise objectionable.


2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or
  6. transfer the materials to another person or 'mirror' the materials on any other server.
  7. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
  8. Copyright: Our Content is protected by copyright under both United States and foreign laws where applicable. Ownership of the Content, where applicable, remains with Prolactancia.


3. Disclaimer

a) The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

b) You may be asked during the registration process to provide your credit card or bank account information (your “payment instrument”). As a user of the Service, you agree that your credit card will be charged, or your bank account debited, the applicable fees and any sales tax and any other charges you may incur in connection with your use of the Service. Except as stated herein, all fees and charges are nonrefundable. 

c) In the event you use your credit card to make purchases on the Service, we may, in our discretion, post charges to your credit card individually or may aggregate your charges with other purchases you make on the Service. You agree to pay all amounts due pursuant to these Terms and to maintain adequate funds or credit balances on your payment instrument to satisfy all amounts due to the Company. 

d) In addition, you are responsible for keeping your Schools’ account confidential and you will be responsible for any charges that are incurred by any person through your School’s account. All charges will be billed to the payment instrument you designate when you first make a purchase or incur a charge on for our Courses and/or services. Any bank fees or charges incurred on your payment instrument by your credit firm or bank are your responsibility. 

e) All prices related to our Courses and services are subject to change by Prolactancia at any time, without notice and without liability to you. Prolactancia does not provide price protection or refunds in the event of a price drop or a promotional offering. 

f) By posting messages, reviews, inputting data, or engaging in any other form of communication through the School (if so permitted by the School) or as part of Prolactancia’s official social networks (“User Generated Content”), you represent that you have all the rights to make such posting, that such posting does not infringe the rights of any third party, and you agree that Prolactancia may copy, sublicense, adapt, transmit, publicly perform or display any such content to provide and/or promote the School’s Courses and services and/or to respond to any legal requirement, claim or threat. 

g) If Prolactancia’s use of the User’s Generated Content, such content exploits any proprietary rights you may have in such material, you agree that Prolactancia has an unrestricted, royalty-free, non-exclusive and perpetual worldwide right do so. You agree that any loss or damage of any kind that occurs as a result of the use of any messages, content or material that you upload, post, transmit, display or otherwise make available through your use of the School is solely your responsibility. Also it is solely your responsibility to monitor and protect any intellectual property rights that you may post in any Prolactancia’s social networks including but not limited to messages, text, illustrations, data, files, images, graphics, photos, comments, sounds, music, videos, information, content, and/or other materials. Prolactancia will not have or accept any responsibility in your name.


4. Limitations

a) In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

b) Further, In no event shall Prolactancia, its licensors, its partners, its suppliers, or any third parties mentioned on our Site, School and/or Courses be liable for any damages (including, without limitation, incidental and consequential damages, or personal injury/wrongful death resulting from the use of or inability to use the Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether Prolactancia, its licensors, its suppliers, or any third parties mentioned on Prolactancia are advised of the possibility of such damages. 

c) Prolactancia, its licensors, its suppliers, or any third parties mentioned on our School are not liable for any personal injury, including death, caused by your use or misuse of the Site or Content. Any claims (if any), arising in connection with your use of our Site, the School and/or our Content must be brought in written form within thirty (30) days after you purchase of any of our Courses and services. Remedies under these Terms of Use are exclusive and are limited to those expressly provided for in these Terms of Use.

d) Some jurisdictions do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, so such exclusions or limitations may not apply to you. TO THE EXTENT THAT IN A PARTICULAR CIRCUMSTANCE ANY DISCLAIMER OR LIMITATION ON DAMAGES OR LIABILITY SET FORTH HEREIN IS PROHIBITED BY APPLICABLE LAW, THEN, INSTEAD OF THE PROVISIONS HEREOF IN SUCH PARTICULAR CIRCUMSTANCE, PROLACTANCIA SHALL BE ENTITLED TO THE MAXIMUM DISCLAIMERS AND/OR LIMITATIONS ON DAMAGES AND LIABILITY AVAILABLE AT LAW AND IN EQUITY BY SUCH APPLICABLE LAW IN SUCH PARTICULAR CIRCUMSTANCE. IN NO EVENT SHALL SUCH DAMAGES OR THE TOTAL AGGREGATE LIABILITY OF THE COMPANY EXCEED THE FEES PAID BY YOU IN THE PRECEDING 12 MONTHS, OR USD $10, WHICHEVER IS GREATER.


5. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.


8. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction (California, United States) without regard to its conflict of law provisions.
